This website is operated by MOTOTOURS S. de R.L. de C.V., hereinafter referred to as “Cactus Tours,” with its registered address in Los Cabos, Baja California Sur, Mexico. By accessing, browsing, or using this site, you expressly agree to the terms and conditions described herein. If you do not agree with any of them, you are advised to refrain from using this site. Cactus Tours reserves the right to modify these terms at any time without prior notice. Users are encouraged to review this section periodically.

Use of the site
This site may include links to other websites operated by third parties. Such links are provided solely for the user’s convenience, and Cactus Tours is not responsible for the content, accuracy, or privacy policies of such external sites. The inclusion of these links does not imply any affiliation or endorsement by Cactus Tours.

Services offered
Cactus Tours offers online reservations for outdoor experiences and activities such as all-terrain vehicle rides (ATV, UTV, Mini RZR), camel rides, horseback riding, and skybike tours. By making a reservation, the user declares being informed of the nature of these activities, which are considered inherently risky, and assumes full responsibility for any consequences arising from their participation.

Reservations and payment methods
All reservations must be made through the Cactus Tours website. Payments are processed through secure platforms such as Stripe, PayPal, and Mifel. By completing the purchase, the user agrees to the cancellation, security, and privacy policies established by the company. Presentation of the card used for payment and an official ID may be required at check-in for verification purposes.

Reservation Deposit

To confirm any activity, a deposit of 30% of the total amount is required.
The reservation is not guaranteed until the deposit is received.
The remaining balance must be paid on the day of the activity, unless the customer chooses to pay the full amount in advance.

Cancellation policy

Deposits:

  • Cancellations made more than 72 hours before the activity: the deposit is refundable, minus administrative fees if applicable.
  • Cancellations made less than 72 hours before the activity: the deposit is non-refundable.

Fully paid activities:

  • Cancellations made more than 48 hours before the activity: the payment may be refundable, minus administrative fees if applicable.
  • Cancellations made less than 48 hours before the activity, late arrivals, or no-show: there are no refunds or changes.
  • Cancellations due to operational or weather-related causes: full refund or change of date without penalty, subject to availability.
  • In cancellations made with the purpose of receiving a discount published after the original purchase, a 20% penalty will apply.
  • Cancellations made less than 48 hours in advance are non-refundable, regardless of the purchase date.

SPECIAL PROMOTIONS

Reservations made under special promotions or discounts do not allow changes or cancellations.

Special discounts and/or promotional codes will be applicable only during the established promotional dates. Such discounts will not be retroactive for reservations made prior to the promotion and/or in cases where the customer fails to enter the promotional code in the corresponding field at the time of booking.

CANCELLATIONS BY THE OPERATOR

Cactus Tours reserves the right to cancel activities due to weather conditions, safety reasons, operational issues, or unforeseen circumstances.

In such cases, the best available alternative will be offered, which may include:

  • Rescheduling the activity
  • Changing to another activity
  • Credit valid for one year
  • Partial or full refund, depending on the case

Cancellation policies do not apply in cases of hurricanes, tropical storms, epidemics, pandemics, or any other natural phenomena; in such cases, only tour rescheduling will apply.

Fraud and verification
In order to prevent fraud, Cactus Tours reserves the right to request additional identity verification before or during service delivery, including banking information and documentation from the payment cardholder. In the event of suspected fraudulent activity, we reserve the right to cancel the reservation without prior notice.

Participation conditions

Participation is not allowed for individuals under the influence of alcohol or drugs.

Activities are not suitable for pregnant women or individuals with medical conditions that may worsen.

All instructions provided by the guide must be followed.

Minimum age, weight, and height requirements may vary depending on the activity.

The use of cameras, cell phones, or recording devices is prohibited during the tours. All personal belongings must be stored in personal code-secured lockers provided for the safety of all participants.

Activity-specific restrictions

UTV / ATV

Minimum driving age: 16 years (official ID may be required).

Not suitable for individuals with back problems, recent surgeries, pregnant women, or those under the influence of substances.

Mandatory use of helmet with visor and/or goggles, seatbelt, and keeping both hands on the steering wheel.

Overtaking, zigzagging, using electronic devices, or extending body parts outside the vehicle is prohibited.

Horseback riding

Minimum age: 6 years (minimum height 1.20 m).

Maximum age: 70 years.

Maximum weight: 110 kg.

Not suitable for individuals with back problems, recent surgeries, pregnant women, or those under the influence of substances.

Mandatory helmet use, suggested posture, and keeping hands on the reins or safety bar.

Camel ride

Minimum age: 5 years (minimum height 1.00 m).

Maximum weight: 130 kg.

Not suitable for individuals with back problems, recent surgeries, pregnant women, or those under the influence of substances.

Mandatory helmet use, proper posture, and compliance with guide instructions.

Skybike

Minimum age: 8 years (minimum height 1.20 m).

Maximum weight: 120 kg.

Participants must comply with all safety instructions and specific conditions indicated by the staff prior to the activity.

Not suitable for individuals with health conditions that may be affected by height or moderate physical exertion.

General safety rules

Follow the guide’s instructions at all times.

Use mandatory safety equipment.

Do not use cameras, cell phones, or electronic devices during the activity.

Maintain a safe distance between participants.

Do not alter the designated route.

Cactus Tours reserves the right to suspend the activity if the participant fails to comply with any of these rules, without the right to a refund.

Limitation of liability
The user assumes full responsibility for their participation. By contracting our services, you release Cactus Tours and its staff from any legal, civil, or criminal liability for accidents, losses, damages, or injuries that may occur during the activities.

Intellectual property
All content on this website, including texts, logos, images, and audiovisual materials, is the exclusive property of Cactus Tours. Reproduction or use without express authorization is prohibited. Unauthorized use may be sanctioned in accordance with applicable law.

Jurisdiction
For any legal matter related to the use of this website or the services offered by Cactus Tours, the parties expressly and irrevocably submit to the laws of the United Mexican States and to the competent courts of Los Cabos, Baja California Sur.
